Entitlement to medical aids
People with statutory health insurance are entitled to the provision of medical aids from their health insurance fund (Section 33 of Book V of the Social Code [SGB V]). Health insurance funds fulfil this entitlement to provision under the principle of benefits in kind by entering into contracts with medical aid providers in accordance with Section 127 of the German Social Code, Book V (SGB V). In doing so, health insurance funds must base the contracts on the requirements of the medical aids directory (§ 139 SGB V) regarding the quality of the medical aids and the provision of care.
In accordance with Section 139 of Book V of the Social Code (SGB V), the GKV-Spitzenverband compiles a systematically structured medical aids catalogue listing the medical aids covered by the statutory health insurance scheme’s obligation to provide benefits. In addition, a care aids catalogue is drawn up as an annex to the medical aids catalogue, listing the care aids covered by the care insurance obligation to provide benefits (Section 78 of Book XI of the Social Code). Both catalogues must be updated regularly (Section 139 of Book V of the Social Code).
Cost coverage
In principle, statutory health insurance will only cover the costs of medical aids if the products are listed in the Medical Aids Catalogue. Although the Medical Aids Catalogue is not legally binding, it does have a market-regulating effect, as has been established by the highest courts in established case law. It provides comprehensive information on the health insurance funds’ obligation to provide benefits, as well as on the type and quality of products available on the market.
The Medical Aids Register provides detailed information on the obligations of health insurance funds to provide benefits, as well as on the type and quality of products. It creates market transparency and serves as a guide and source of interpretation for health insurance funds and other parties involved in healthcare provision.
